Terms of Service - MMOPrime

These Terms of Service ("Terms") govern access to and use of the MMOPrime website (the "Service", "we", "us", "administration").

By creating an account or using the Service, you agree to these Terms. If you do not agree - do not use the Service.

1. The Service

MMOPrime is a platform for ranking, monitoring, and voting for game servers. Features may include:

- a server catalog and server cards;

- voting and ranking systems;

- player reviews;

- a server owner dashboard;

- paid promotion and advertising placements;

- API and related tools.

We may change, suspend, or discontinue any part of the Service at any time.

2. Accounts

Some features require registration. You must provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account.

Email verification may be required for access to the dashboard and certain features.

You may not:

- create accounts for abuse, fraud, vote manipulation, or automation that harms the Service;

- share access in a way that compromises security;

- bypass bans, limits, captcha, or security controls;

- create multiple accounts to evade voting limits or moderation.

We may refuse registration, restrict, or delete an account that violates these Terms.

3. User Content

You retain rights to content you submit (server descriptions, images, links, reviews, profile data, and similar materials). By submitting content, you grant MMOPrime a non-exclusive, royalty-free license to host, store, display, and distribute that content as needed to operate and promote the Service.

You are responsible for your content. Illegal, fraudulent, insulting, defamatory, deceptive, infringing, or otherwise harmful materials are prohibited.

We may remove, edit, or restrict content that violates these Terms or applicable law.

4. Listing Servers in the Catalog

An owner or authorized representative may add a server to the catalog through the dashboard. A listing may be published after review by the administration.

By listing a server, you confirm that:

- you have the right to publish information about it;

- descriptions, images, IP/domain, links, and other materials do not infringe third-party rights or applicable law;

- the information provided is accurate and not misleading.

Important:

- we do not operate, own, or control third-party game servers;

- we do not guarantee the accuracy, uptime, fairness, economy, safety, or legality of any server in the catalog;

- any relationship between players and server operators exists solely between those parties;

- you decide on your own whether to join a third-party server and interact with it.

We may reject a listing, edit a description, hide a server, or remove it from publication if it violates these Terms, appears to mislead users, or for other reasonable moderation reasons.

5. Voting, Rankings, and Reviews

Votes, ranking position, and reviews reflect user activity and opinions on the Service. They are not an official quality assessment of a server.

5.1. Voting

You may not:

- inflate votes with bots, scripts, proxy farms, vote exchanges, or other automated or organized schemes;

- create accounts or use someone else's accounts to cast extra votes;

- bypass voting limits, captcha, IP/device checks, or other anti-fraud measures;

- encourage or pay for vote inflation.

We may cancel votes, recalculate rankings, limit voting, or ban an account if we suspect manipulation - including based on technical signals and activity patterns.

5.2. Reviews

Reviews may be moderated. You may not:

- post reviews under someone else's name;

- publish insults, threats, doxxing, defamation, or knowingly false statements;

- spam or advertise unrelated projects outside the review context;

- manipulate rankings through mass fake reviews.

We may delete or hide a review that violates these Terms.

6. Acceptable Use

When using the Service, you may not:

- violate applicable law;

- scam, phish, doxx, or deceive users;

- disrupt the website, create excessive load, or exploit vulnerabilities;

- scrape or collect user data by automated means without our permission;

- abuse the API (if provided): exceed rate limits, bypass access keys, or use the API to harm the Service or inflate votes;

- post malware or links to malware;

- impersonate another person or a member of the administration;

- spam, manipulate rankings, or abuse moderation tools;

- infringe intellectual property or other third-party rights.

We may investigate suspicious activity and take action: content removal, vote cancellation, restrictions, or bans.

7. Advertising Materials and Paid Promotion

The Service may offer paid promotion and advertising placements, including:

- highlighting / boosting a server in the ranking and catalog;

- priority positions and special placements;

- banners, teasers, text-and-image blocks, and other ad formats on Service pages;

- other advertising and promo services available in the dashboard.

7.1. Ordering and ad moderation

By submitting advertising materials, the customer confirms that:

- they have the right to use and publish them;

- the materials comply with advertising law and other applicable rules;

- the materials do not contain prohibited, deceptive, harmful, or third-party-rights-infringing content;

- landing pages and offered services match the advertising description.

We may reject, pause, or remove an ad without compensation for the remaining term if the materials violate these Terms, the law, or Service rules, or for reasonable moderation/security reasons.

7.2. What payment covers

Unless a specific offer states otherwise:

- payment is for placement, visibility, or ad impressions on the Service for an agreed term / volume;

- paid placement does not guarantee votes, clicks, traffic, server online numbers, sales, or any other commercial result;

- payment does not waive voting rules or the ban on vote inflation;

- advertising does not mean our endorsement, partnership, or guarantee of quality for the promoted server/project.

8. Payments, Acceptance of Payment, and Refunds

8.1. Subject of payment

Paid features of the Service are digital services (listing, promotion, advertising, and related services). A service is considered provided when the placement is activated / impressions begin / access to the paid feature is granted under the order.

8.2. Prices and currency

Current prices are shown in the dashboard or on the order page at the time of payment. We may change prices for future orders. An already paid order is fulfilled at the price at the time of payment, unless otherwise agreed.

Unless stated otherwise, the price may include applicable taxes, or taxes may be added separately - according to the payment page and the requirements of the payment provider / applicable law.

8.3. Payment method

Payment is accepted through third-party payment providers / payment systems. By completing a payment, you also accept the provider's terms.

We do not store full card details ourselves unless expressly required and separately disclosed; payment data is processed by the provider.

A payment is considered completed after we receive confirmation of successful payment from the payment system.

8.4. Right to refuse / cancel an order

We may refuse an order, decline to activate a service, or cancel an order if we suspect fraud, chargeback abuse, a Terms violation, technical limits, or requirements of the payment provider / law. If funds were charged and the service was not provided, a refund is handled under sections 8.5-8.6.

8.5. Refund policy

Unless a specific offer/checkout states otherwise:

Refunds are generally not provided if:

- the paid service has already been activated and/or the placement / impression period has started;

- the customer changes their mind after payment;

- a server / ad is removed or restricted because the customer violated these Terms (vote inflation, prohibited content, deception, etc.);

- the customer is dissatisfied with vote counts, traffic, or commercial results, since those are not guaranteed;

- funds were credited to the account balance and have already been partly or fully spent on Service features.

If a user topped up their balance and did not use those funds, a refund may be considered only for the unused remaining amount of that payment. Amounts already deducted from the balance for activated services are non-refundable.

A refund may be considered (in full or in part) if:

- the service was not provided due to our fault (not activated without lawful grounds);

- there was a technical double-charge / clear billing error;

- otherwise expressly provided by the specific product terms or applicable law.

Refund requests must be sent to support with the payment / order number and reason.

Deadlines:

- a refund request may be submitted within 14 calendar days from the payment date;

- requests submitted after this period are generally not considered, unless otherwise required by law;

- review of a complete refund request takes up to 10 business days from receipt of all required information;

- if a refund is approved, funds are returned within 10 business days after the approval decision.

Refunds are issued only to the same payment details / payment method used for the original payment. Refunds to other details are not provided. Actual credit timing to the payer's account may additionally depend on the bank and payment provider.

8.6. Payment disputes (chargebacks)

Before initiating a chargeback / dispute with a bank or payment system, you must first contact our support to try to resolve the issue.

Unfounded chargebacks, repeated disputes without grounds, or payment with stolen/unauthorized funds may result in account suspension, cancellation of services, and sharing of information with the payment provider / competent authorities where required by law.

8.7. Balance / credits (if available)

If the Service provides an internal balance or advertising credits:

- they are not a bank deposit and are generally not withdrawable as cash;

- they may be used only to pay for Service features;

- any expiry / burn rules, if any, are shown in the interface.

8.8. Invoices and confirmations

Payment confirmation and/or receipt/invoice (if issued) are provided in the dashboard and/or to the email on the account.

9. Intellectual Property

The Service brand, design, structure, software, and original materials belong to us or our licensors. You may not copy, reverse engineer, or use the Service except as allowed by these Terms or law.

Third-party game names, logos, and trademarks belong to their owners and are used for identification. This does not imply affiliation with rights holders unless expressly stated.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

- uninterrupted, secure, or error-free operation of the Service;

- full accuracy of rankings, vote counts, online status, or server descriptions;

- the truthfulness of reviews and information posted by users;

- any commercial result from paid promotion or advertising.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MMOPrime AND ITS OPERATOR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM USE OF THE SERVICE OR THIRD-PARTY SERVERS.

Our total liability for any claim relating to the Service shall not exceed the greater of: (a) the amount you paid us for the specific paid feature giving rise to the claim in the 3 months before the claim, or (b) USD $50 (or local currency equivalent).

12. Indemnity

You agree to defend and indemnify us against claims, damages, and expenses arising from your content, listed server, advertising materials, vote inflation, payments/chargeback abuse, use of the Service, or your violation of these Terms or third-party rights.

13. Termination

You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.

We may suspend or terminate access, hide a server, remove advertising, or cancel voting results if you violate these Terms, if required by law, or to protect the Service and users.

14. Changes

We may update these Terms. The current version is always available on the Service Terms of Service page.

Continued use of the Service after changes means you accept the updated Terms.
